Article L323-7 du Code de l'énergie
Lorsque l'institution des servitudes prévues à l'article L. 323-4 entraîne un préjudice direct, matériel et certain, elle ouvre droit à une indemnité au profit des propriétaires, des titulaires de droits réels ou de leurs ayants droit.
L'indemnité qui peut être due à raison des servitudes est fixée, à défaut d'accord amiable, par le juge judiciaire.
