Article R221-5 du Code de l'énergie
Une personne soumise à une obligation d'économies d'énergie en application de l'article R. 221-3 peut, pour chaque période définie à l'article R. 221-1 et pour les obligations définies à l'article R. 221-4 ou à l'article R. 221-4-1 :
1° Déléguer la totalité de son obligation d'économies d'énergie de la période à un tiers ;
2° Déléguer une partie de son obligation d'économies d'énergie de la période à un ou plusieurs tiers. Dans ce cas, le volume de chaque délégation partielle ne peut pas être inférieur à 1 milliard de kWh cumac avant la sixième période et à 2 milliards de kWh cumac à compter de cette période.
Sous réserve des dispositions de l'article R. 221-7, une personne ayant délégué la totalité de ses obligations individuelles n'est plus considérée comme une personne soumise à une obligation d'économies d'énergie.
