Article D221-17-1 du Code de l'énergie
Dans le cadre d'une opération d'économies d'énergie consistant à créer une nouvelle installation industrielle ou à étendre une installation industrielle existante, en particulier à la suite d'une relocalisation d'activité, l'installation ou l'ensemble des installations concernées atteint, après l'achèvement de l'opération, un niveau de performance en matière de consommation d'énergie et d'émissions de gaz à effet de serre supérieur à celui associé à la situation de référence mentionnée à l'article R. 221-16.
