Article L2141-7 du Code de la commande publique
L'acheteur peut exclure de la procédure de passation d'un marché les personnes qui, au cours des trois années précédentes, ont dû verser des dommages et intérêts, ont été sanctionnées par une résiliation ou ont fait l'objet d'une sanction comparable du fait d'un manquement grave ou persistant à leurs obligations contractuelles lors de l'exécution d'un contrat de la commande publique antérieur.
