Article L2193-2 du Code de la commande publique
Au sens du présent chapitre, la sous-traitance est l'opération par laquelle un opérateur économique confie par un sous-traité, et sous sa responsabilité, à une autre personne appelée sous-traitant, l'exécution d'une partie des prestations du marché conclu avec l'acheteur.
Le sous-traitant est considéré comme entrepreneur principal à l'égard de ses propres sous-traitants.
