Article L2195-5 du Code de la commande publique
Lorsqu'un marché n'aurait pas dû être attribué à un opérateur économique en raison d'un manquement grave aux obligations prévues par le droit de l'Union européenne en matière de marchés qui a été reconnu par la Cour de justice de l'Union européenne dans le cadre de la procédure prévue à l'article 258 du Traité sur le fonctionnement de l'Union européenne, l'acheteur peut le résilier.
