Article L2324-1 du Code de la commande publique
Lorsque la valeur estimée hors taxe du besoin est égale ou supérieure aux seuils européens mentionnés dans un avis qui figure en annexe au présent code, l'acheteur passe le marché de défense ou de sécurité selon l'une des procédures formalisées définies par le présent chapitre, dans les conditions et selon les modalités fixées par décret en Conseil d'Etat.
