Article L2341-6 du Code de la commande publique
Lorsqu'un opérateur économique est, au cours de la procédure de passation d'un marché, placé dans l'un des cas d'exclusion mentionnés aux sections 1 et 2, il informe sans délai l'acheteur de ce changement de situation.
Dans cette hypothèse, l'acheteur exclut le candidat ou le soumissionnaire de la procédure de passation du marché pour ce motif.
