Article R2393-31 du Code de la commande publique
L'acheteur ne peut agréer les conditions de paiement d'un sous-traitant si l'exemplaire unique ou le certificat de cessibilité n'a pas été modifié ou si la justification mentionnée à l'article R. 2193-6 ne lui a pas été remise.
Le silence de l'acheteur gardé pendant vingt-et-un jours à compter de la réception des documents mentionnés au premier alinéa et à l'article R. 2393-27 vaut également acceptation du sous-traitant et agrément des conditions de paiement.
