Article R2372-19 du Code de la commande publique
Dans les marchés de défense ou de sécurité présentant des aléas techniques importants, notamment ceux comportant une part de développement ou relatifs au maintien en conditions opérationnelles de matériels, l'acheteur peut prévoir, dans des cas dûment justifiés, l'acquisition en cours d'exécution d'une part de fournitures ou de services qui n'ont pu être définis avec précision dans le marché public initial.
Ces fournitures ou ces services doivent être liés à l'objet du marché et nécessaires à son exécution.
