Article R2372-20 du Code de la commande publique
Le recours à la faculté mentionnée à l'article R. 2372-19 doit être indiqué dans les documents de la consultation.
La part des fournitures ou des services qui pourront être acquis en cours d'exécution sans avoir été définis dans le marché initial et les conditions de fixation du prix de ces fournitures ou services doivent être indiqués dans le marché. Cette part doit être justifiée et ne peut être supérieure à 15 % du montant total du marché initial.
