Article R2343-8 du Code de la commande publique
L'acheteur accepte comme preuve suffisante attestant que le candidat ne se trouve pas dans un cas d'exclusion mentionné à l'article L. 2341-1, à l'article L. 2141-4, au 1° de l'article L. 2341-3 et à l'article L. 2141-5, la production soit d'une attestation sur l'honneur, soit d'un extrait de casier judiciaire.
Le candidat établi à l'étranger produit un extrait du registre pertinent ou, à défaut, un document équivalent délivré par l'autorité judiciaire ou administrative compétente du pays d'origine ou d'établissement de l'opérateur économique, attestant de l'absence de cas d'exclusion.
