Article R2192-37 du Code de la commande publique
Les personnes morales de droit public dotées d'un comptable public peuvent recourir à la carte d'achat comme modalité d'exécution des marchés dans les conditions prévues par le décret n° 2004-1144 du 26 octobre 2004 relatif à l'exécution des marchés par carte d'achat.
Ne peuvent faire l'objet d'une exécution par carte d'achat :
1° Les marchés de travaux, sauf décision de l'acheteur motivée par des besoins d'entretien et de réparation courants n'ayant pas fait l'objet d'un programme ;
2° Les marchés faisant l'objet d'une avance forfaitaire ou facultative.
