Article R2172-34 du Code de la commande publique
Ces marchés sont conclus au terme d'une procédure de mise en concurrence conforme aux dispositions du présent livre, limitée à des opérateurs économiques choisis parmi ceux dont les projets auront été sélectionnés par le jury du programme public national, après publication d'un avis de marché.
Un protocole d'expérimentation est passé entre l'acheteur et l'organisme public responsable du programme national.
