Article R2171-16 du Code de la commande publique
Un jury est désigné par l'acheteur à l'exception des cas suivants :
1° Pour les marchés de conception-réalisation passés par les pouvoirs adjudicateurs dans les hypothèses énumérées aux 1° à 3° et au 5° de l'article R. 2172-2 ;
1° bis Pour les marchés globaux de performance passés par les pouvoirs adjudicateurs dans les hypothèses énumérées à l'article R. 2172-2 ;
2° Pour les marchés de conception-réalisation et les marchés globaux de performance passés par les entités adjudicatrices selon la procédure de dialogue compétitif ou selon la procédure avec négociation.
