Article R2121-7 du Code de la commande publique
Pour les marchés de fournitures ou de services qui répondent à un besoin régulier, la valeur estimée du besoin est déterminée sur la base :
1° Soit du montant hors taxes des prestations exécutées au cours des douze mois précédents ou de l'exercice budgétaire précédent, en tenant compte des évolutions du besoin susceptibles d'intervenir au cours des douze mois qui suivent la conclusion du marché ;
2° Soit de la valeur estimée des prestations qui seront exécutées au cours des douze mois ou de l'exercice budgétaire qui suit la conclusion du marché.
