Article R2112-16 du Code de la commande publique
Les clauses des marchés conclus à prix provisoires précisent :
1° Les conditions dans lesquelles sera déterminé le prix définitif, dans la limite d'un plafond éventuellement révisé ;
2° L'échéance à laquelle le prix définitif devra être fixé ;
3° Les règles comptables auxquelles le titulaire devra se conformer ;
4° Les vérifications sur pièces et sur place que l'acheteur se réserve d'effectuer sur les éléments techniques et comptables du coût de revient.
