Article R2112-14 du Code de la commande publique
Les marchés d'une durée d'exécution supérieure à trois mois qui nécessitent pour leur réalisation le recours à une part importante de fournitures, notamment de matières premières, dont le prix est directement affecté par les fluctuations de cours mondiaux comportent une clause de révision de prix incluant au moins une référence aux indices officiels de fixation de ces cours, conformément aux dispositions de l'article R. 2112-13.
Toutefois, les marchés de fourniture de gaz ou d'électricité peuvent être conclus à prix ferme conformément aux usages de la profession.
