318. In which cases does the rule of exhaustion of trademark rights apply?

According to the principle of exhaustion of rights, a holder cannot prohibit the use of their trademark for products that have been placed on the market in the European Union or in the European Economic Area (EEA) under this trademark by themselves or with their consent (Art. L. 713-4, para. 1, IP Code).
