Principal lease

Under the terms of Article L. 145-8 of the Commercial Code, the right to renew the lease can only be invoked by the owner of the business operated on the leased premises. In the event of a sublease of the entire premises, they lose this status since the subtenant is the owner of the business operated on the premises, and, consequently, no longer benefits from the status of commercial leases .

On the other hand, when the premises are partially subleased, the tenant continues to operate their business in part of the premises. Thus, they retain the benefit of the commercial lease status and their right to renew the main lease. Nevertheless, their right to renew the lease applies to all leased premises only in the case of material or contractual indivisibility of those premises (Art. L 145-32, para. 2, Commercial Code) . Therefore, if the premises are not contractually or materially indivisible, the tenant has the right to renew their lease only for the part of the premises they occupy themselves .
