Indeed, positive, clear, and unequivocal acts are required for the waiver to be identified as a tacit approval of the subletting , or its renewal .

Thus, the lessor tacitly agrees to the sublease when they issue a request for an increase in the rent of the main lease in which they mention the sublease , or when they grant authorization directly to the subtenant to carry out work on the premises . Similarly, the lessor tacitly authorized the sublease if they knew, from the conclusion of the initial lease, that the premises were intended to be fully subleased and maintained direct relations with the subtenant during successive leases for the execution of work or security commission inspections .
