Articles R. 145-24 and R. 145-25 of the Commercial Code determine the content of the memorandum. Article R. 145-24 specifies that it must indicate the surname, first names, profession, domicile, nationality, date and place of birth of the natural person to whom it is addressed. When it concerns a legal entity, its name and registered office, as well as the title and surname and first names of its legal representative, must be included in the memorandum.

The brief must then contain, pursuant to Article R. 145-25:

- a copy of the request for price determination made pursuant to either Article L. 145-11 or Article R. 145-20;

- the legal and factual explanations likely to justify the claims of their author or to refute those of the other party.

When it comes to a reply brief, it may only contain legal or factual justifications .

The brief, which must accompany the request for setting the price of the renewed lease or the revised rent, must, therefore, under penalty of inadmissibility, be preceded by a request for revision . Indeed, the brief that is notified to the opposing party, prior to the referral to the judge, is a distinct act from the initial request for price revision and produces other effects, its notification not constituting a prior request . The request for revised rent is thus inadmissible when it has been notified after the request brief, this situation not being subject to regularization by this notification . However, the brief, which does not contain a copy of the request for setting the price, is not tainted with a substantive irregularity , as no prejudice results for the recipient .
