6. Requirement of lease

Pursuant to Article L. 145-1, I of the Commercial Code, “the provisions of this chapter,” in reference to the rules relating to the status of commercial leases, apply to “leases of buildings or premises,” to the exclusion of any movable property. It follows that the regime of commercial leases is intended to govern a contractual relationship necessarily involving a lease.
