Le ministre fédéral de l'Économie et de l'Énergie peut autoriser une concentration interdite par l'OFC si, dans un cas spécifique, la restriction de concurrence est compensée par des avantages pour l'économie dans son ensemble, ou si la concentration est justifiée par un intérêt public prépondérant (article 42 GWB).
