Reverse discrimination

Article 34 TFEU only prohibits national measures which apply discriminatory treatment to products imported from other Member States . It is not designed to ensure that goods of national origin enjoy the same treatment as imported goods . Reverse discrimination is therefore accepted regarding the free movement of goods: Member States may adopt measures that are less favorable to national products than to goods from other Member States .

A national law may thus impose the use of a sales name solely on national products but not imported products which are lawfully manufactured and marketed under a different name in another Member State  and may prohibit only national vessels from discharging certain substances, even outside territorial waters , or make both products intended for the national market and those intended for export subject to an administrative certification but provide exemption from certification only for the latter .
