Administrative simplification

The objective of the Services Directive is to simplify procedures for the establishment of an undertaking in a Member State. Member States must set up points of single contact so that providers can carry out the procedures and formalities necessary for access to and exercise of a service activity, such as declarations, notifications, or applications necessary for authorization from the competent authorities, including applications for inclusion in a register, a roll or a database, or for registration with a professional body or association (Art. 6). Those formalities and procedures must be able to be easily completed, at a distance and by electronic means (Art. 8).

The setting up of points of single contact must also facilitate access to certain information: requirements applicable to providers established in their territory; contact details of the competent authorities; the means of and conditions for, accessing public registers and databases; the means of redress which are generally available in the event of dispute with the competent authorities; the contact details of the associations or organizations from which providers or recipients may obtain practical assistance. This obligation of assistance is an obligation to provide general information and does not require the competent authority to provide legal advice in individual cases. Information must be provided in a clear and unambiguous manner, must be easily accessible at a distance and by electronic means and be kept up to date (Art. 7).
