Formal requirements

Under Article 5 of Regulation No 773/2004 the complaint must contain the information set out in Form C which can be found in the annex to the Commission Notice on the handling of complaints . Three paper copies as well as, if possible, an electronic copy of the complaint must be submitted to the Commission. The complainant also submits a non-confidential version of the complaint. The complaint must contain as much information as possible concerning:

- the identity of the complainant, including whether the complainant is acting in its capacity as representative and if so must provide proof of such authority , and details concerning the undertaking/s whose conduct the complaint relates to ,

- existence of a legitimate interest in the initiation of proceedings,

- products and services at issue and market concerned,

- evidence, in fact and in law of the infringement complained of ,

- any measures, including interim measures, requested of the Commission.

The complainant must also provide copies of relevant supporting documentation reasonably available to him/her and, to the extent possible, provide indications as to where relevant information and documents that are unavailable could be obtained by the Commission. Correspondence to the Commission that does not comply with the requirements of Article 5 of Regulation No 773/2004 and therefore does not constitute a complaint within the meaning of Article 7(2) of Regulation No 1/2003 is considered as general information that, where it is useful, may lead to an own-initiative investigation .

The complainant may retain anonymity but in that case does not benefit from any procedural or follow-up guarantees.
