The position of the EU authority therefore deprives the action for failure to act of any purpose. When the act whose omission is the purpose of the dispute has been adopted after a letter before action has been sent but before the Court's decision is adopted, the action for failure to act becomes devoid of purpose .

The EU court has set out the outline for the concept of “definition of position”. Although the existence of a pending investigation , or a letter rejecting the complaint , amounts to a definition of position, such is not the case of the publication of a notice in accordance with a text other than that referred to in the formal request  or the termination of the restriction of competition complained of . Where it has been ruled that the action had ceased to have any purpose, it is not necessary to examine the admissibility of that action .
