The Commission may take measures intended to restore or maintain conditions of effective competition in three cases; where the concentration has been implemented:

- in contravention of a decision of suspension, where no decision as to the compatibility has been taken,

- in contravention of a condition attached to a decision,

- although the concentration is declared incompatible.

Those are interim measures. A request for interim measures, ancillary to the action on the substance against an incompatibility decision, must be rejected where the applicant requires that the effects of those measures continue beyond the date of the decision in the main action . Orders may be imposed on third parties to the proceedings, provided that the rights of defense are complied with and that those measures are indispensable to prevent the applicant from being exposed to a situation liable to endanger its very existence .
