With a distinction that is both logical and chronological, going from the oldest and most subjective rules that are closest to ordinary civil law to the most recent, objective and specific rules, competition law has three main facets.

Unfair competition law can be found at one extreme (Chapter 2). Appearing at the beginning of the 19th century, unfair competition law, which falls within the jurisdiction of the ordinary courts, requires that the existence of a tort be conclusively established. At the opposite extreme, competition law in the narrower sense may be itself divided into two sub-categories: restrictive agreements and abuse of dominance (Chapter 4) and merger control (Chapter 6). This law, which is the most recent and objective is governed by a specific procedure set up by specialized bodies (Chapter  5).

Between the two extremes, we find the law governing commercial negotiations i.e. transparency and restrictive practices (Chapter 3), which may be classified as "intermediary": more objective than unfair competition law, yet more subjective than competition law. The administrative authorities (DGCCRF) have the same investigatory powers as in competition proceedings and can adopt administrative fines in respect of certain behavior.
