30. Evaluation of harm

The harm is assessed according to the precepts of ordinary law . The courts have a discretionary power of assessment and do not have to detail the various elements of the harm or justify the assessment criteria used . In any case harm resulting from acts of unfair competition cannot be evaluated on a lump-sum basis where there is insufficient data to make the assessment .
