CA Paris, 20 November 2020, LawLex202000003324JBJ: an e-commerce platform, which is paid per “click” and which displays on the first pages of its site numerous products of a well-known brand of children's clothing, of which it knows that a large majority - 93% of the items displayed - are unavailable, even though they are likely to remain displayed for 30 days, and which refers users to the possibility of seeing similar competing products, commits an act of unfair competition by using the brand in question in order to attract customers and to offer articles of other brands in an attempt to generate traffic on its site.
