As in European law, an agreement which is restrictive of competition has three constituent elements. In order for it to exist, a restriction of competition observed on the market must be linked to collusion between several undertakings.

Agreements involving the use of inventions are not automatically excluded from antitrust provisions . Practices which consist in artificially prolonging the length of patent-conferred monopoly rights are also punishable under this heading . The principle of freedom of contract does however allow patentees to organize their own licensing policy, for instance by favoring undertakings who take on the technological risks necessary for extending use to new areas by charging higher licensing fees as the patent nears its end .
