Under Article L. 121-1 (former Article L. 120-1) of the Consumer Code, to be qualified as unfair, the practice must distort or be likely to distort “the economic behavior of the reasonably well-informed and reasonably observant and circumspect consumer”. This definition incorporates the terms used by recital 18 of Directive No 2005/29 of 11 May 2005 on unfair commercial practices which states: “[ …
