This criterion, enshrined in new Article 6a of Directive No 98/6, incorporated into Directive No 2019/2161, and transposed in Article L. 112-1-1 of the Consumer Code by Ordinance No 2021-1734, has become the sole criterion for defining the reference price since 28 May 2022.
