Under Article 1645 of the Civil Code, “if the seller was aware of the defects in the thing, he is bound not only to return the price he received but also to pay all damages to the buyer”. Damages must not be confused with the costs incurred by the sale which the seller is required to pay, in accordance with Article 1646 of the Civil Code.
