158. Enforceability.

A jurisdiction clause, even valid, may be unenforceable in certain cases. The issue is discussed on a regular basis as part of bankruptcy proceedings, tort actions or summary proceedings. The mandatory jurisdiction which is now conferred to eight specialized courts for actions involving competition law and Article L. 442-1 et seq. may alter the effect of jurisdiction clauses.
