Renewal or amendment of registration.

Since the adoption of the Decree of 2 November 2010, the validity of the registration with the register of commercial agents and of the acknowledgment of statement is no longer limited to five years as of the registration date and therefore do not have to be renewed .

By contrast, Article R. 134-6(3) of the Commercial Code requires that “any fact which is likely to change one of the affirmations contained in the statement of registration” be declared . The amended statement is drawn up in duplicate with the same documents as those submitted at the time of the initial application ; this may be carried out by electronic means .

Article R. 134-7, repealed by the Decree, restricted to five years the validity of the registration and required the registration to be renewed subject to the criminal penalties set forth in Article R. 134-15, 3º, also repealed. 

Commercial Code, Article R. 134-6: "The registration number shall appear in all business printed documents of the interested party".

Commercial Code, Article R. 134-13: "Statements relating to the registration of commercial agents, the change in their situation or the termination of their activity may be made by electronic means where they may be transferred and received through that way; for all communications by electronic means mentioned in the first indent a secured electronic signature is used under the conditions laid down in Article 1316-4  (now Article 1367)of the Civil Code and in the Decree No 2001/272 of 30 March 2001 implementing it. However, for statements relating to the registration of commercial agents, this electronic signature may result from the use of a process which answers to the conditions defined in the first sentence of the second indent of Article 1316-4 (now Article 1367) of Civil Code; the registrar acknowledges receipt of any communication made to him as soon as he receives it in accordance with the terms and conditions set forth by the order provided for in Article 14".
