A basic patent, which must exist in order for a certificate to be granted, is defined by Article 1 of Regulation No 469/2009 of 6 May 2009 as a patent which protects a product, a process to obtain a product or an application of a product, and which is designated by its holder for the purposes of the procedure for grant of a certificate.
