The transfer of title to the transferee entitles the latter to institute infringement proceedings, subject to registration of the transfer in the national patent register (Art. L. 613-9 IP Code). If the transfer agreement has not been entered in the national patent register by the time the transferee brings an infringement action, such registration may be carried out in accordance with Article 126 of the Code of Civil Procedure. The transferee's suit is then admissible if the registration is made before the date of the judgment.

Only the transferee may take action against acts of infringement subsequent to the date on which the sale takes effect. Infringement acts committed prior to the transfer may only be pursued by the transferor, unless a contrary provision of the contract expressly reserves this right to the transferee . The agreement may provide for the transferee's right to sue for acts of infringement committed prior to the conclusion of the transfer agreement  or to pursue, at its own costs, proceedings initiated by the transferor and pending before the court . Such provisions must be entered in the national patent register to be enforceable against third parties . As from the registration of the transfer of patent ownership, and if the instrument transferring the rights so provides, the assignee may obtain compensation for the damage resulting from acts of infringement committed both before and after the assignment .
