Publication of the patent

Law No 90-1052 of 26 November 1990 was designed to ensure the widest possible publicity for patent applications, patents and associated rights, using all modern communication techniques. The INPI ensures publication by mention in the Official Bulletin of Industrial Property (Bulletin officiel de la propriété industrielle), by making the full text available to the public, or by dissemination via a database or electronic media distribution (Article L. 612-21 IP Code) of:

1° the file of any application for a patent or utility certificate at the end of a time-limit of eighteen months from the date of filing, or from the priority date if priority has been claimed, or, at the simple request of the applicant, before the expiry of this time-limit;

2° any application for a supplementary protection certificate, appended to the patent application to which the certificate relates or, if the latter application has already been published, as soon as it is filed;

5° all acts transmitting or amending the rights attached to a patent application or patent;

6° the date of the authorization referred to in Article L. 611-3, with an indication of the corresponding patent.

The INPI holds the original texts of patents, for consultation by any interested party, until ten years after the expiry of the rights attached to the patents (Article R. 612-75, al. 2, IP Code). It also keeps a national patent register, a public document which records all acts transferring or amending the rights attached to a patent application or patent (Article L. 613-9 IP Code). Its organization and operation are defined by Articles R. 613-53 et seq. of the Intellectual Property Code. In particular, article R. 613-57 stipulates that changes of name, legal form or address, and corrections of material errors, must be recorded at the request of the applicant or of the owner of the patent. This change is made by the INPI's director general on production of a slip, with no supporting documents required . All entries in the national patent register are published in the Official Bulletin of Industrial Property (Article R. 613-59 IP Code).
