Prior to the Decree of 30 September 1953 , forfeiture was a sanction for failure to exploit the patent by its owner . This ground for forfeiture was abolished and replaced by the mechanism of compulsory license for failure to exploit, codified in Articles L. 613-11 and L. 613-12 of the Intellectual Property Code.
