An applicant who makes a submission for provisional or precautionary measures must have standing to bring an infringement action within the meaning of Article L. 716-4-2 of the Intellectual Property Code. Those with such standing are the proprietor of the mark, the licensee with the consent of the proprietor, the exclusive licensee if, after formal notice, the proprietor of the mark has not exercised this right within a reasonable period of time, or the person entitled to use a guarantee mark or collective mark with the consent of the proprietor, unless otherwise provided for in the rules of use.

An applicant for registration of a trademark can also request a provisional or precautionary measure if entitled to bring an infringement action, a right that was previously unavailable to such persons . The order may be issued against the alleged infringer, but also against the intermediaries whose services he or she uses (Art. L. 716-4-6, para. 1, IP Code). The concept of intermediary includes any economic operator who provides a service likely to be used by one or several other people to infringe one or several intellectual property rights, without it being necessary to have a particular relationship with such person(s) . This is the case of a market hall tenant who sublets space to merchants who use it to sell counterfeits of branded goods .
