Action on the merits

When provisional or precautionary measures are ordered prior to any action on the merits, the plaintiff must either take civil or criminal action, or file a complaint with the Public Prosecutor (Art. L. 716-4-6, paragraph 5, IP Code). Failing this, at the request of the defendant and without the latter having to state the reasons for the request, the measures ordered are annulled, without prejudice to any damages that may be sought.

The deadline for the applicant to appeal on the merits is twenty working days, or thirty-one calendar days if this deadline is longer. It runs from the date of the order (Art. R. 716-15 IP Code), provided that the parties were effectively informed by the court of the date on which the order would be issued . Simply indicating the date of the deliberation in the pleadings of the respondents before the Court of Appeal does not prove that they were effectively informed by the court on the day of the closing of the arguments . If the party concerned has not been effectively informed, the period begins to run on the date on which he or she had actual knowledge of the ruling by any means .
