The decision to invalidate has an absolute effect (Article L. 716-2-2 IP Code): it eliminates the first filing, without the court having to declare the cancellation of the trademark . Once it has become irrevocable, it must be published in the National Register of Trademarks . The cancellation of the trademark entails the cancellation of all contracts relating to it, in particular trademark licenses . Since the invalidity has an absolute effect, claims for trademark infringement become groundless .

When a court is called upon to hear a plea of trademark invalidity raised as a defense to an infringement action, it can only render a judgment of invalidity with effect for all, and not simply render a judgment dismissing the infringement action committed against the claimant of the invalidity . The scope of this remedy, which constitutes a reversal of the previous case law that considered that the courts did not have to declare the invalidity of the trademark if the defendant did not request it , remains ambiguous, since it could be justified by the facts of the case, and would clash with the lack of jurisdiction of the criminal courts to declare the invalidity of a trademark.

When the grounds for invalidity only partially affect the registration of a trademark, it is only partially invalidated (Art. L. 716-2-2, para. 2, IP Code).
