Invalidity of a design is declared by a court judgment. The PACTE Law of 22 May 2019 had envisaged the introduction of administrative proceedings for design invalidity before the INPI, similar to those in trademark law, but this option was not adopted. It does, however, feature in the draft directive of the Designs Package .
