Legal action may be initiated by the owner of the design rights, or by the public prosecutor. The right holder may lodge a complaint as a civil party under the conditions of Article 85 of the Code of Criminal Procedure, or, if the facts are straightforward, act by way of direct summons (Art. 389 to 392-1 and 550 to 566 Code of Criminal Procedure).
