The Ordinance of 25 July 2001 translated the concept of “informed user” used in Article 5 of Directive No 98/71 into that of “informed observer” in French. The latter is defined as an observer endowed not with average attention but with a particular vigilance, whether because of personal experience or extensive knowledge of the sector in question .
