Appeals against decisions of the Tribunal

Pursuant to section 65 of the Act, the Superintendent-General's clearance of the transaction in phase 1 may be appealed before the Tribunal by any interested third party within 15 days of the decisions' publication. The case is handled by a Tribunal Council member, who will issue an opinion on whether further investigation is necessary. The Tribunal may on the basis of such opinion decide or not to open phase 2 proceedings. The notifying parties may intervene to submit their own comments.

The exercise of the right of appeal may lead to the imposition of a fine of R$5,000 to R$5 million (US$ 956 to US$ 956,377) on the appellant if s/he is proven to be of bad faith and acted on the sole purpose of delaying the approval of the transaction.
