891. Abuse of a dominant position

Abuse of dominance has been the most important area of antitrust enforcement. The prohibition in Section 3(b) includes illustrations of behavior that would be regarded as abuse of dominance: abusive prices, tying and dividing markets. Section 3(c) prohibits “predatory or unfair competitive practices conducted in order to attain keep or increase a dominant position.”
